Mining Regulation 2016

Applications for exploration and mining titles may be made in a number of ways in NSW.

To assist potential applicants in selecting a lodgement method, the tables below outline the times at which applications are formally received.

Formal application receipt times are determined in accordance with the Mining Regulation 2016.

In Person

At the time the application is recorded as having been received by the delegated receiving officer between the hours of 9.30am -4.30pm.

Office location is provided at the end of this page. Offices are open weekdays, excluding NSW public holidays

Email

If an application is lodged via e-mail the application is presumed to have been lodged on the date and at the time determined by the relevant information system in accordance with the Electronic Transactions Act 2000.

Online

Following completion of a successful online application, the system will generate an application number and the time and date will be automatically recorded by the online lodgement method.

Additional information

If an application is lodged in person it is at the actual time received with the exceptions:

  • if it is lodged before 9.30am Monday-Friday (excluding public holidays), the actual receipt time will be 9.30am on that day
  • if an application is lodged in person after 4.30pm the application will officially be received at 9.30am the following working day.

In the case of lodgement of an application by facsimile the application is presumed to have been lodged on the date and at the time shown on the last page of the application that is received by the facsimile.

For applications lodged via e-mail, the application is presumed to have been lodged at the date and time of the date/time stamp of receipt of the e-mail (this may differ from the time the email was sent by the sender).

Online applications are automatically issued with a time and date of receipt when entered into the system.

Mineral Claim applications in relation to land within the Lightning Ridge Mineral Claims District must be lodged in person at the Lightning Ridge office of the Department.

Mineral Claim applications in relation to land within the White Cliffs Mineral Claims District may be lodged in person at, or by post or facsimile to, the Lightning Ridge office of the Department.

If an application is required to be accompanied by a fee, the application is taken to have been lodged on the date determined in accordance with the above time frames only if the fee is paid to and received by the Department.

Petroleum (Onshore) Act 1991

Applications are received in accordance with Section 11 of the Petroleum (Onshore) Act 1991.

Applications for petroleum titles must be delivered or forwarded by post to the Director-General.

Payment methods

Application fees may be paid by the following methods:

  • Cash - payable over the counter at our Maitland office
  • Cheque – payable to "NSW Department of Planning and Environment"
  • Credit card – Mastercard, Visa, American Express, Diners
  • Direct Deposit – payable to the Department via Electronic Funds Transfer – refer to your application form for appropriate bank account details.
